For those of you following the story of the Saratoga County Sheriff’s (ex)Sergeant who was caught on tape slapping a man, the two men involved in the case announced that they plan to sue Saratoga County as well as the former Sergeant, Shawn R. Glans. Colin Fitch and Adam Roberts met with their attorney, Terence Kindlon, on Monday and sent a notice to the Saratoga County attorney as well as the county sheriff concerning the plan to bring charges against the county and the sergeant for violating their constitutional rights.
The Fourth Amendment protects against unreasonable search and seizure, and the Second Amendment is the right to bear arms (in case you didn’t know). The young man’s lawyer stated that Fitch produced a receipt for his rifle to Glans and the other two officers who were present at the time of the incident. Although as many of our readers are aware, a permit is not required to possess a rifle. Kindlon said,
“If somebody takes the Fourth Amendment to the Constitution to wipe the mud off his feet, then that’s a problem.”
Glans has since resigned after being charged with official misconduct, a misdemeanor, and harassment for allegedly striking Fitch.
Local news reported that Kindlon is currently handling six other cases concerning police misconduct, one of which involves a local community college football player who was allegedly beaten and tased by police after he was reportedly caught jaywalking.
